INTELLECTUAL PROPERTY

The Site as a whole, as well as each of its individual elements (including but not limited to text, diagrams, site architecture, software, animations, images, photographs, illustrations, videos, graphic or editorial representations, logos, etc.), constitute intellectual works protected by the French Intellectual Property Code and all other applicable international legislation.

Only HOTEL OCEAN is authorised (either directly or through licenses or permissions) to use the elements comprising the Site, the domain names, trademarks, models, and all images and editorial content reproduced on the Site.

Use of all or part of the Site — in particular through downloading, reproduction, transmission, display or distribution — for any purposes other than private, non-commercial consultation and use by the user is strictly prohibited. Any violation of these provisions may subject the perpetrator to legal sanctions as outlined by the Intellectual Property Code (especially in cases of copyright or trademark infringement) and the Civil Code (in relation to civil liability).

Creating any hyperlink redirecting to any page or element of the Site is prohibited without prior written authorization, which may be revoked at any time. Any content, website, or platform linking to the Site or any of its elements is not under the control of HOTEL OCEAN, which therefore disclaims all responsibility — including editorial — regarding access to or content of those external sites.

SITE AVAILABILITY

HOTEL OCEAN makes every reasonable effort to ensure continuous access to the Site but is under no obligation to do so. Access to the Site may be interrupted, particularly for maintenance, updates, or other technical or editorial reasons, without prior notice or warning to users. HOTEL OCEAN shall not be held liable for any consequences of such interruptions, whether for users or third parties.

Furthermore, HOTEL OCEAN shall not be held liable if users are unable to access all or part of the Site due to technical issues, including but not limited to:

  • Failure and/or congestion of the internet network

  • Failure of internet service providers

  • Human or electrical error

  • Malicious interference

  • Software or hardware malfunctions

  • Force majeure

LIABILITY

HOTEL OCEAN makes every effort to ensure the accuracy and regular updating of the information published on the Site and reserves the right to modify its content at any time, without prior notice.

However, HOTEL OCEAN cannot guarantee the accuracy, precision, or completeness of the information available on the Site. Such information does not constitute a guarantee or commitment on the part of HOTEL OCEAN toward the user. In particular, HOTEL OCEAN shall not be held liable for:

  • Any inaccuracy, error, or omission in the said information

  • Any damage resulting from a third-party intrusion that alters the said information

  • More generally, any direct or indirect damage, regardless of its causes, origins, nature, or consequences, related to access to (or the inability to access) the Site, its content, use of the Site, and/or reliance on any information obtained from the Site

TERMS & CONDITIONS OF SALE

INTRODUCTION

1.1 The Site allows clients to book rooms and additional services at the Joli Môme hotel (hereinafter the “Hotel”).

1.2 These general terms and conditions of sale (the “General Terms and Conditions”) apply to the booking of rooms and additional services at the Hotel (the “Services”) and are those in force at the date of your reservation confirmation on the Site. They cancel and replace all previous versions of the General Terms and Conditions that were published online and/or accepted by the Client.

1.3 Any reservation made on the Site implies full and unconditional consultation and acceptance of the General Terms and Conditions. It is recommended to download and/or print the General Terms and Conditions to keep a copy on the date of your reservation, as they may be subject to modification. However, any changes made after the reservation has been confirmed shall not apply to that reservation.

1.4 The Client agrees to the General Terms and Conditions and the specific conditions of each booking — including financial terms — by proceeding with the reservation and checking the box “By choosing to book, I acknowledge that I have read and accepted the General Terms and Conditions and the Privacy Policy of Joli Môme” or any similar prompt displayed on the Site.

1.5 The Client acknowledges having all necessary information available on the Site, including: the complete contact details of the Hotel (available in the “Terms of Use” section), the main and essential characteristics of the accommodations and additional services offered, these General Terms and Conditions, the special conditions applicable to each offer and/or accommodation and/or additional service(s), the Privacy Policy, the pricing of rooms and services, the maximum number of rooms that can be booked by one Client, the payment methods and terms, and the duration of the contract entered into between the Client and the Hotel.

1.6 The term “Client(s)” refers to any individual placing an order on the Site as a consumer, for personal or professional purposes, but not in connection with the hotel industry.

1.7 As consumers, Clients benefit from certain rights that may be waived if the Services are booked as part of a professional, commercial, industrial, artisanal, or freelance activity.

1.8 Only Clients who (i) have reached the age of majority (eighteen in most countries) and (ii) have the legal capacity to enter into contracts are authorized to order Services on the Site.

1.9 The information provided on the Site is presented in French and in English.

2. PURPOSE

2.1 These General Terms and Conditions define the terms and conditions applicable to the online booking of Services through the Site.

2.2 The General Terms and Conditions do not govern the offer, booking, or purchase of Services provided by entities other than Joli Môme and available through third-party websites and/or mobile applications. Before confirming any booking of Services via third-party platforms, we recommend that Clients review their general terms and conditions of sale, as Joli Môme cannot be held liable for the provision of Services by third parties.

2.3 These General Terms and Conditions apply to all stages of the Service booking process and its follow-up by the Client.

3. RESERVATION

3.1 The Site offers an online booking process for hotel rooms, allowing for a maximum of four (4) rooms per reservation, along with additional services.

3.2 The accommodation offers presented on the Site include an information sheet with, where applicable: the type of commercial offer (e.g. “Book now and pay less,” “Last minute -10%,” “Flexible rate,” “Room & breakfast,” “Celebrate your birthday at the hotel”), a description of the room(s) concerned, any included services, applicable cancellation and modification terms, and where relevant, special sales conditions, payment methods and terms, and the General Terms and Conditions.

3.3 Occasionally, the Site offers promotional deals available exclusively on the Site and not on third-party platforms, such as limited-time offers labeled “Best Rate Guaranteed.” In such cases, Clients are invited to review the special conditions applicable to these offers, which are disclosed at the time of booking. These commercial offers may be changed at any time by Joli Môme, which is only contractually bound by bookings confirmed by the Client. Joli Môme cannot be held liable for the modification or withdrawal of an offer listed on the Site.

3.4 The Client selects the Services offered on the Site. The Client alone is responsible for choosing the Services and their suitability to their needs. Joli Môme may not be held liable in this respect.

3.5 Clients may book up to four (4) rooms on the Site. For reservations of more than four rooms or for any request not listed on the Site, we invite you to contact Joli Môme directly. For reservations of five (5) or more rooms, group conditions may apply, including a required deposit and specific cancellation and modification terms. For more information, please contact Joli Môme.

3.6 A reservation is deemed accepted by the Client at the end of the booking process.

3.7 The Client confirms the accuracy and truthfulness of all information provided when making the reservation. Joli Môme reserves the right to cancel any reservation from a person using the Site fraudulently or in violation of these General Terms and Conditions.

4. BOOKING PROCESS

4.1 Reservations are made by the Client through a digital booking form accessible on the Site.

4.2 At the time of booking, the Client must provide certain mandatory information, including personal data necessary for processing the reservation by Joli Môme, which reserves the right to refuse any reservation if such data is missing or incorrect. The Client must also indicate the number of people included in the reservation and their ages — any minor over the age of 13 is considered an adult.

4.3 The online booking process on the Site includes the following steps:

  • Step 1: Select the arrival date on the homepage of www.maisonmere.co

  • Step 2: A secure page displays available offers for the selected Hotel and dates, allowing the Client to adjust choices (arrival/departure dates, number of rooms, number of guests, etc.)

  • Step 3: View and select an offer

  • Step 4: Optionally add one or more additional Services

  • Step 5: Verify booking details, total price, and applicable conditions; make any necessary changes

  • Step 6: Enter the Client’s contact information

  • Step 7: Provide payment details in case of guarantee or prepayment

  • Step 8: Review and accept the General Terms and Conditions, Privacy Policy, and where applicable, any special conditions

  • Step 9: Confirm the reservation

5. BOOKING CONFIRMATION

5.1 The Site acknowledges receipt of the Client’s reservation by sending an email containing (i) the reservation number, (ii) a booking summary including Services reserved, pricing, and the applicable conditions accepted by the Client, (iii) the General Terms and Conditions, and if applicable, after-sales information and the contact address for complaints.

5.2 The reservation becomes final and binding upon receipt of this confirmation email from Joli Môme.

5.3 The duration of the contract between the Client and the Hotel corresponds to the duration of the accommodation specified in the reservation.

6. CANCELLATION OR MODIFICATION BY THE CLIENT

6.1 Pursuant to Article L.221-28 of the French Consumer Code, the Services offered on the Site are not subject to the right of withdrawal provided for in Articles L.221-18 and following of the same Code concerning distance selling contracts.

6.2 The sales conditions for each rate specify the terms of cancellation and/or modification.

6.3 Reservations made with prepayment cannot be modified or cancelled. The amounts paid in advance are considered deposits and are non-refundable, as indicated in the pricing conditions available to and accepted by the Client at the time of booking.

6.4 When cancellation is allowed, the Client must contact the Hotel’s customer service directly. Contact details are available on the Hotel’s website.

6.5 Some promotional offers on the Site include special conditions for cancellation and modification, which are detailed in their specific terms listed on the offer page.

6.6 Unless otherwise stated, cancellations or modifications are free of charge only if made at least 48 hours before the scheduled arrival time. Any cancellation made less than 48 hours before the scheduled arrival will incur a penalty of one night, automatically charged to the Client’s credit card provided at the time of booking.

6.7 To modify a reservation on the Site, the original reservation must first be cancelled under the applicable conditions, and a new booking must be made.

7. NO-SHOWS AND EARLY DEPARTURES

7.1 All reservations made on the Site include a check-in time of 3:00 p.m. and a check-out time of 12:00 p.m. Clients must arrive before 6:00 p.m. or notify the Hotel in case of late arrival. If the Client does not arrive by 6:00 p.m., one night’s penalty will be charged to the credit card provided at booking, unless the reservation was prepaid.

7.2 If the reserved room is vacated after the required check-out time (12:00 p.m.), an additional night will be charged as a penalty.

7.3 Any early departure before the scheduled check-out date will result in full payment of the reserved stay.

8. PRICING

8.1 Prices for the Services are shown on the Site both before booking and during the reservation process, via the offer description.

8.2 Rates are per room, based on the number of persons and period selected, and include only the Services explicitly mentioned in the reservation.

8.3 All prices are inclusive of VAT, excluding tourist tax. The VAT amount applicable to the Service is clearly indicated.

8.4 The euro (€) is the official currency of the reservation. Payment must be made in euros. Prices shown in other currencies are for reference only and may not reflect the final amount due, which will be confirmed in euros at the time of booking confirmation.

8.5 Prices listed on the Site are subject to change at any time by Joli Môme without prior notice. Only the price stated in the confirmation email is contractually binding.

9. PAYMENT

9.1 Unless otherwise specified, payment for Services is due at the Hotel upon departure. For prepaid bookings, the amounts paid are considered deposits and are non-refundable.

9.2 In the event of no-show or late cancellation incurring a penalty, the Client’s credit card details provided at the time of booking will be used to collect the applicable charges.

10. STAY AT THE HOTEL

10.1 In accordance with French law, the Client may be asked to complete a police registration form upon arrival. An identity document may be required to verify whether the Client is subject to this requirement.

10.2 Joli Môme allows certain animals, provided they are leashed or in a carrier in public areas. For more information, the Client is advised to contact the Hotel directly. The animal remains the Client’s full responsibility throughout the stay.

10.3 During the stay, the Client agrees to use the room responsibly and with care. The Hotel may ask the Client to leave without compensation and require payment for the entire stay in the event of: behavior contrary to good morals or public order; damage, vandalism, or degradation caused by the Client, their guests, or anyone under their responsibility — whether to movable or immovable property, furnishings, decor, or any other item present in the Hotel. The Client will also be fully liable for the cost of any damage caused. Joli Môme reserves the right to take any legal action necessary to obtain compensation for the damage incurred.

10.4 Joli Môme provides free Wi-Fi internet access throughout the Hotel. The Client agrees not to use this access for any illegal or fraudulent purposes, including but not limited to copyright infringement or illegal downloading of protected content, which is punishable under Article L.335-2 of the French Intellectual Property Code.

11. RELOCATION – FORCE MAJEURE

11.1 In the event of unavailability of the reserved room at the Hotel, Joli Môme reserves the right to relocate the Client, in full or in part, to a hotel of equivalent or superior category offering similar Services. All transfer costs will be borne by Joli Môme, and no additional charges will be requested from the Client by the substitute hotel.

11.2 Joli Môme shall not be held liable for failure to fulfill its obligations in the event of force majeure, for the duration of such force majeure event. Joli Môme agrees to make all reasonably necessary efforts to minimize the effects of such an event.

11.3 For the purposes of this Article, force majeure refers to any event or circumstance that the parties could not reasonably foresee or control at the time of booking, due to its external, unforeseeable, and irresistible nature. Events deemed force majeure include, but are not limited to, those recognized by French courts and tribunals: total or partial strikes (internal or external to the Hotel), terrorism, wars or uprisings, adverse weather, epidemics, transport or supply blockages for any reason, earthquakes, fires, storms, floods, water damage, or computer system failures that hinder the normal continuation of a Party’s activities.

12. PERSONAL DATA

12.1 In accordance with Law No. 2018–493 of 20 June 2018 on the protection of personal data and the General Data Protection Regulation No. 2016/679 (GDPR), the Client is informed that the information provided at the time of booking is subject to personal data processing for purposes including reservation and client management, billing and payment, and commercial prospecting.

12.2 The Client is also informed that the hotel is equipped with a video surveillance system in its common areas for the safety of people and property.

12.3 The Client has the right to access, rectify, transfer, or delete their personal data. This right can be exercised by contacting Joli Môme at the following email address: hello@maisonmere.co.

12.4 The Client may also request information on how Joli Môme processes their personal data by consulting the Privacy Policy or contacting us at hello@maisonmere.co or by writing to our registered office at: 7 rue Mayran, 75009 Paris, France.

12.5 The Client may register their phone number (and that of their spouse or children) with Bloctel, a free service allowing users to block telephone solicitation. Decree No. 2022-1313 of 13 October 2022 stipulates that from 1 March 2023, marketing calls to consumers will only be allowed Monday to Friday, from 10:00 a.m. to 1:00 p.m. and from 2:00 p.m. to 8:00 p.m. They will be prohibited on Saturdays, Sundays, and public holidays. These regulations apply to all individuals, whether or not they are registered on the “Bloctel” list, and even to those contacted in the context of an ongoing contract. 13. MEDIATION – JURISDICTION

13.1 In the event of a dispute, after first contacting the establishment at hello@maisonmere.co and failing to receive a satisfactory response within one year, the Client may refer the matter to the Association of European Mediators at the following address:

13.2 The platform https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&Ing=FR may also be used for online dispute resolution.

14. GENERAL PROVISIONS

14.1 The Terms and Conditions of Sale are updated regularly, particularly in response to regulatory changes. The new Terms and Conditions will apply from the date of their publication on the Site.

14.2 These Terms and Conditions of Sale, including the Privacy Policy, Terms of Use of the Site, and any special terms for specific offers, constitute the entire agreement between the Client and Joli Môme regarding reservations made on the Site. They supersede all previous versions of the Terms and Conditions.

14.3 If any provision of these Terms and Conditions is deemed null and void, in whole or in part, for any reason, the remaining provisions shall remain in full force and effect.
